Abstract
En los 90´s, se crearon los organismos reguladores de la inversión privada en
servicios públicos en el Perú, y, en el 2000, se promulgó la Ley N° 27332, Ley
Marco de los Organismos Reguladores de la Inversión Privada en los Servicios
Públicos, estableciéndose un marco normativo importante para la autonomía de
los mismos. Sin embargo, desde su vigencia, ha sido objeto de propuestas
modificatorias. Una cuestión que fomenta el análisis crítico sobre las materias
que se proponen modificar ya que, en la mayoría de casos, afectan directa o
indirectamente la independencia de los organismos reguladores.
Bajo ese contexto, se analizará la viabilidad de la propuesta que buscaba
modificar la Ley N° 27332, a propósito del Proyecto de Ley N° 7752/2023-CR
propuesto por la Presidencia del Consejo de Ministros; así como los riesgos que
podrían generarse por la creación de un organismo regulador multisectorial con
un modelo integrado. Para ello, se realizará un análisis cualitativo a partir de la
revisión de normas, jurisprudencia y doctrina con el fin de señalar la importancia
de la independencia e institucionalidad de los organismos reguladores dentro del
ordenamiento jurídico peruano.
In the 1990s, regulators for private investment in public services were created in Peru, and in 2000, Law No. 27332, the Framework Law for Regulatory for Private Investment in Public Services, was enacted, establishing an important regulatory framework for their autonomy. However, since it came into force, it has been the subject of proposed amendments. This issue encourages critical analysis of the matters that are proposed to be amended, since, in most cases, they directly or indirectly affect the independence of regulators. In this context, the viability of the proposal that sought to modify Law No. 27332 will be analyzed, in relation to Bill No. 7752/2023-CR proposed by the Presidency of the Council of Ministers; as well as the risks that could be generated by the creation of a multisectoral regulators with an integrated model. To this end, a qualitative analysis will be carried out based on the review of norms, jurisprudence and doctrine in order to point out the importance of the independence and institutionality of regulators within the Peruvian legal system.
