Análisis de la eficiencia del procedimiento administrativo disciplinario por faltas concernientes a hostigamiento sexual dentro de la función pública

Abstract
En el Perú, a través de la Ley N° 27492, sus modificatorias y su reglamento, en
complementariedad con la Ley del Servicio Civil- Ley N° 30057, se ha pretendido
prevenir y erradicar el hostigamiento sexual que afecta la dignidad, la integridad
y la igualdad de género. Por ello, el legislador al observar que existían casos de
hostigamiento sexual dentro de las entidades en detrimento de la función pública
estableció un procedimiento administrativo disciplinario para todos los servidores
públicos que realicen este tipo de actos hostiles dentro de su Entidad. Sin
embargo, de la investigación realizada, se ha podido observar que a pesar de
encontrarse tipificada la falta por hostigamiento sexual dentro de la
administración pública, el procedimiento administrativo disciplinario a la misma
no es eficiente.

Therefore, the legislator, upon observing that there were cases of sexual harassment within the entities, to the detriment of the public function, determined an administrative disciplinary procedure for all public servants who perform this type of hostile acts within their Entity. However, from the investigation carried out, it has been observed that although sexual harassment within the public administration is typified, the administrative disciplinary procedure is not efficient.
