La transformación de los procedimientos sujetos al silencio positivo en procedimientos de aprobación automática en el ordenamiento jurídico administrativo peruano

Abstract
En medio de la tendencia hacia la simplificación administrativa, el ordenamiento
jurídico administrativo peruano ha ido ampliando los supuestos para la aplicación
de los procedimientos de aprobación automática. De esta manera,
procedimientos que anteriormente habían sido calificados como de evaluación
previa sujetos al silencio positivo, hoy son reformulados dando lugar a
procedimientos de aprobación automática que, de una forma más célere y
eficiente, dan respuesta a las solicitudes y necesidades de los administrados. En
el marco de estas consideraciones, el presente trabajo desarrolla, desde una
aproximación conceptual y normativa, al silencio positivo y a la aprobación
automática, apreciando sus similitudes, así como los propósitos que subyacen a
cada uno de ellos de cara a los procedimientos administrativos. Así, a partir de
este desarrollo, se elabora una propuesta de pautas para efectuar la
transformación de los procedimientos administrativos hacia la aprobación
automática, las cuales giran en torno a una evaluación integral de los
procedimientos, en la que se encuentra involucrado el principio de
proporcionalidad.
In the midst of the tendency towards administrative simplification, the Peruvian administrative legal system has been expanding the scope for the application of automatic approval procedures. In this way, procedures that had previously been qualified as prior evaluation procedures subject to positive silence, are now reformulated giving rise to automatic approval procedures that, in a faster and more efficient way, respond to the petitions and needs of the citizens. Within the framework of these considerations, this paper develops, from a conceptual and normative approach, positive silence and automatic approval, appreciating their similarities, as well as the purposes underlying each of them with regard to administrative procedures. Thus, based on this development, a proposal is drawn up with guidelines for the transformation of administrative procedures towards automatic approval, which revolve around an integral evaluation of the procedures, in which the principle of proportionality is involved.
