La deficiente regulación de la figura del apoyo y las facultades de representación en el marco del Decreto Legislativo N° 1384: análisis doctrinario, normativo y de pronunciamientos del Tribunal Registral

Resumen
A través del Decreto Legislativo N° 1384 y su reglamento, en el Perú se ha
regulado la figura del apoyo e incluso se ha establecido que se podrá otorgar
facultades de representación a la persona que ha sido designada como apoyo a
pesar de que la Convención sobre los Derechos de las Personas con
Discapacidad en ningún artículo hizo referencia a esta posibilidad.
Por lo tanto, en el presente trabajo se definirá y diferenciará las figuras del apoyo
y la representación con el objetivo de establecer un marco conceptual adecuado.
Y posteriormente, se analizará dicho decreto y su reglamento, así como también
los pronunciamientos del Tribunal Registral en materia de precedente de
observancia obligatoria y acuerdo plenario con la finalidad de identificar los
problemas en nuestra regulación.
De esta forma, se analizarán los problemas generados por nuestra regulación en
situaciones como la designación de apoyo en el caso de las personas que no
pueden manifestar su voluntad o en el caso de las personas sin pleno
discernimiento. Asimismo, se desarrollará como la falta de claridad en la
diferenciación entre ambas figuras ha generado confusión que se puede
evidenciar en los pronunciamientos del Tribunal Registral sobre el tema.
En consecuencia, a partir del análisis de estos puntos en el presente trabajo, se
podrá concluir que efectivamente la regulación del apoyo en nuestro
ordenamiento jurídico resulta deficiente y existen diversos aspectos a mejorar
con la finalidad de poder establecer un correcto sistema de apoyos para las
personas con discapacidad.
Through Legislative Decree No. 1384 and its regulations, Peru has regulated the role of support and even established that powers of representation may be granted to the person who has been designated as support, despite the fact that the Convention on the Rights of Persons with Disabilities does not refer to this possibility in any of its articles. Therefore, this paper will define and differentiate between the roles of support and representation in order to establish an appropriate conceptual framework. Subsequently, it will analyze the decree and its regulations, as well as the rulings of the Registry Court on binding precedents and plenary agreements, in order to identify problems in our regulations. In this way, we will analyze the problems generated by our regulations in situations such as the designation of support in the case of persons who cannot express their will or in the case of persons without full discernment. Likewise, we will discuss how the lack of clarity in the differentiation between the two figures has generated confusion, which can be seen in the pronouncements of the Registry Court on the subject. Consequently, based on the analysis of these points in this paper, it can be concluded that the regulation of support in our legal system is indeed deficient and that there are several aspects that need to be improved in order to establish a proper support system for persons with disabilities.
