La calificación registral y el control de legalidad bajo el procedimiento de eliminación de barreras burocráticas: legitimidad y límites del control del INDECOPI sobre las actuaciones de la SUNARP

Abstract

La presente investigación estudia la legitimidad, los alcances y los límites del control de legalidad que ejercen los órganos de eliminación de barreras burocráticas del Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual (INDECOPI) sobre aquellos actos, disposiciones y actuaciones materiales emitidas, en el marco de la función calificadora, por la Superintendencia Nacional de los Registros Públicos (SUNARP). El análisis parte del reconocimiento de que la calificación registral, aun cuando responde a un procedimiento especial, autónomo y no contencioso, constituye una manifestación de la función administrativa y, en tal condición, debe respetar estrictamente el marco de legalidad que rige a toda actuación estatal. Desde esta premisa, es posible concluir que la actividad calificadora puede ser sometida a un control ex post de legalidad a través del procedimiento regulado en el Decreto Legislativo N.º 1256, que aprueba la Ley de prevención y eliminación de barreras burocráticas. En ese sentido, el estudio analiza los elementos concurrentes del concepto de “barrera burocrática” y los fundamentos legales que sustentan su inaplicación, así como los limites materiales previstos en el Código Civil y otras normas complementarias que restringen la potestad calificadora. Sobre esta base, se desarrolla un análisis de la jurisprudencia del INDECOPI aplicable a medidas impuestas por la SUNARP, evaluando las resoluciones en las que se declaró la improcedencia de la denuncia, por recaer sobre materias propias del sentido de lo resuelto, y aquellas en las que se identificaron barreras burocráticas ilegales vinculadas a requisitos no previstos en la ley y a cobros no contemplados en la normativa tarifaria vigente. Los casos estudiados permiten demostrar que, cuando la SUNARP impone exigencias, limitaciones, requisitos, prohibiciones o cobros sin sustento normativo o excediendo los márgenes de su potestad reglada, las mismas pueden configurar barreras burocráticas ilegales susceptibles de inaplicación. Por el contrario, cuando las denuncias pretenden cuestionar, entre otros, la motivación, interpretación normativa o la valoración técnica realizada por el registrado público, el INDECOPI carece de competencia para intervenir. Se concluye que el control ejercido por el INDECOPI no vulnera, en modo alguno, la autonomía técnica de la SUNARP, sino que la complementa, reforzando el principio de legalidad, la eficiencia administrativa y la seguridad jurídica del tráfico económico formal. Su compatibilidad con la función calificadora garantiza, a criterio del autor, un equilibrio institucional adecuado. Mientras que la SUNARP conserva la competencia técnica sobre la calificación registral, el INDECOPI determina (de oficio o a solicitud de parte) si dicha potestad se ejerce atendiendo a los límites y condiciones fijados por el sistema jurídico nacional.

This research examines the legitimacy, scope, and limits of the legality control exercised by the bureaucratic barriers elimination bodies of the Instituto Nacional de Defensa de la Competencia y Protección de la Propiedad (INDECOPI) over acts, regulations, and material actions issued, within the framework of the qualifying function, by the Superintendencia Nacional de los Registros Públicos (SUNARP). The analysis begins by acknowledging that registral qualification, although conducted through a special, autonomous, and non-contentious procedure, constitutes an expression of administrative authority and, as such, must strictly adhere to the legality framework governing all state action. From this premise, it follows that the qualifying activity may be subject to ex post legality review through the procedure established in Legislative Decree N.° 1256, which approves the Law on the Prevention and Elimination of Bureaucratic Barriers. In this regard, the study examines the concurrent elements of the concept of a “bureaucratic barrier,” the legal grounds supporting its non-application, and the material limits set forth in the Civil Code and complementary regulations that restrict the scope of the qualifying authority. On this basis, the research develops an analysis of INDECOPI’s case law applicable to measures imposed by SUNARP, assessing both the resolutions in which complaints were declared inadmissible—because they concerned matters inherent to the substance of the registral decision—and those in which INDECOPI identified illegal bureaucratic barriers linked to requirements not provided for by law or to charges not contemplated in the applicable tariff regulations. On this basis, the research develops an analysis of INDECOPI’s case law applicable to measures imposed by SUNARP, assessing both the resolutions in which complaints were declared inadmissible—because they concerned matters inherent to the substance of the registral decision—and those in which INDECOPI identified illegal bureaucratic barriers linked to requirements not provided for by law or to charges not contemplated in the applicable tariff regulations. The study concludes that the legality control exercised by INDECOPI does not undermine SUNARP’s technical autonomy; rather, it complements it by reinforcing the principle of legality, administrative efficiency, and the legal certainty required for formal economic transactions. In the author’s view, its compatibility with the registral qualification function ensures an appropriate institutional balance: while SUNARP retains exclusive technical authority over registral qualification, INDECOPI ensures that such administrative power is exercised within the limits mandated by the Peruvian legal system.
