La importancia de la prueba indiciaria para acreditar el delito de colusión: análisis desde la reciente jurisprudencia de la Corte Suprema de Justicia de la República

Abstract
La prueba indiciaria en el marco de la imputación del delito de colusión ha sido de suma
utilidad para acreditar el acuerdo colusorio que exige el tipo penal. En razón a ello,
mediante la presente investigación se busca aportar un análisis sobre la importancia de
la prueba indiciaria para corroborar el delito aludido, con dicho propósito se realiza una
recopilación de la jurisprudencia relevante sobre la materia recientemente emitida por las
Salas Penales de la Corte Suprema de Justicia de la República del Perú. Dicha
jurisprudencia permite comprender los criterios jurisprudenciales que se han adoptado al
valorar pruebas indiciarias en el marco de la imputación del referido delito.
En ese sentido, las sentencias que se han recopilado van en una línea en la cual se ha
valorado positivamente las pruebas aportadas, pues las mismas han permitido advertir
irregularidades impropias de un procedimiento de contratación transparente, las que en
aplicación de los criterios establecidos en el artículo 158 del Código Procesal Penal y el
Acuerdo Plenario 1-2006, que tratan el tema de la prueba indiciaria en el Perú,
permitieron construir certeza en el juzgador sobre la ocurrencia del acuerdo colusorio en
cada caso en específico.
The circumstantial evidence within the framework of the accusation of the crime of collusion has been extremely useful to prove the collusive agreement required by the criminal offense. For this reason, through this investigation we seek to provide an analysis of the importance of the circumstantial evidence to corroborate the crime in question. For this purpose, a compilation of the relevant jurisprudence on the matter recently issued by the Criminal Chambers of the Supreme Court of Justice of the Republic form Peru. Said jurisprudence allows us to understand the jurisprudential criteria that have been adopted when evaluating indicative evidence within the framework of the imputation of the aforementioned crime. In this sense, the sentences that have been compiled are in a line in which the evidence provided has been positively valued, since it has made it possible to detect irregularities inappropriate to a transparent contracting procedure, which, in application of the criteria established in the Article 158 of the Criminal Procedure Code and Plenary Agreement 1- 2006, that deal with the issue of circumstantial evidence in Peru, allowed the judge to build certainty about the occurrence of the collusive agreement in each specific case.
