Calificación Registral de solicitud de rectificación de estado civil y calidad de bien sobre predio adjudicado por entidad administrativa

Abstract
El presente artículo pretende determinar que sí cabe rectificar, en sede registral, la
calidad de un bien de un predio que fue adjudicado por ente administrativo, conforme
con el artículo 75 del RGRP y artículo 15 del RIRP. Así, al encontrarnos ante
adjudicación de predios, cuyo título que da merito a la inscripción lo constituyen
resoluciones administrativas, actos administrativos, si bien, conforme al Tribunal
Registral, no se puede evaluar los fundamentos de hecho o de derecho que ha tenido
la Administración para emitir el acto administrativo, consideramos que ello no es
acorde con el con el TUO del RGRP y el articulo 10 del Reglamento de Inscripción
del Registro de Predios. Es así que, estos preceptos normativos señalan que la
validez del acto es objeto de calificación. Asimismo, se indica que la resolución
administrativa que declara derechos inscribibles a favor de persona casada debe
señalar la calidad del bien. Ello por cuanto, al tratarse de una persona que es casada,
le son aplicables las reglas de presunción de bienes sociales dadas por ley, salvo que
se demuestre lo contrario. Esto más aún si tenemos en cuenta que al tratarse de un
registro de seguridad jurídica las inexactitudes deben ser rectificadas dada la
consecuencia a la que conlleva la inscripción, como son dar publicidad y legitimidad
al titular del derecho.
The purpose of this academic paper is to determine if it is possible to rectify the legal status of the property that was adjudicated by an administrative entity, in accordance with article 75 of the RGRP and article 15 of the RIRP. Thus, when dealing with the adjudication of properties, whose title that gives merit to the registration is constituted by administrative resolutions, administrative acts, although, according to the Registry Court, it is not possible to evaluate the factual or legal grounds that the Administration has had to issue the administrative act, we consider that this is not in accordance with the TUO of the RGRP and article 10 of the Regulation of Registration of the Registry of Properties. Thus, these normative precepts indicate that the validity of the act is subject to qualification. Likewise, it is indicated that the administrative resolution declaring registrable rights in favor of a married person must indicate the legal status of the property. This is because, being a married person, the rules of presumption of social property given by law are applicable to him/her, unless the contrary is proved. This is even more so if we take into account that since it is a registry of legal certainty, inaccuracies must be rectified given the consequences of the registration, such as giving publicity and legitimacy to the holder of the right.
