Abstract
Entre precepto y norma existe una diferencia de grado, el precepto es el
dispositivo legal contenido en un texto normativo; en cambio, la norma es el
sentido y alcance. En ese sentido, a los operadores jurídicos les corresponde
establecer cuál es el contenido de un precepto material o procesal, para ello se
debe recurrir a los métodos de interpretación y exponer razones positivas para
respaldar una determinada posición. En ocasiones se suscitan aparenten
contradicciones entre determinados preceptos regulados en diversos códigos o
Leyes, solamente llegaremos a la conclusión de que estamos frente a una
antinomia, cuando se ha superado todos los métodos de interpretación; en otras
palabras, la existencia de antinomias es la última ratio.
En ese contexto, la rehabilitación en el delito de agresiones presenta
diversos problemas. Por un lado, posiciones que sostienen que es suficiente,
para proceder a la rehabilitación del condenado cumplir con la pena impuesta -
en la mayoría de casos jornadas de prestación de servicios a la comunidad- y el
pago de la reparación; por otro lado, tesis donde indica que además se debe
cumplir con el tratamiento psicológico. Así, considero que la segunda opción es
la adecuada, ya que se sostiene en la interpretación teleológica de la Ley n.°
30364 y la interpretación sistemática.
Between a precept and a norm, there is a difference in degree. The precept is the legal provision contained in a normative text; in contrast, the norm refers to its meaning and scope. In this sense, it is the responsibility of legal operators to determine the content of a material or procedural precept. To do so, they must resort to interpretative methods and provide positive reasons to support a particular position. Occasionally, apparent contradictions arise between certain precepts regulated in various codes or laws. We will only conclude that we are facing an antinomy once all interpretative methods have been exhausted; in other words, the existence of antinomies is the last resort. In this context, rehabilitation in the crime of assault presents various problems. On one hand, some argue that it is sufficient for the convicted person to serve the imposed sentence—usually community service—and pay compensation in order to proceed with rehabilitation. On the other hand, there are views that suggest psychological treatment must also be completed. Thus, I consider the second option to be the most appropriate, as it is based on the teleological interpretation of Law No. 30364 and systematic interpretation.
