Abstract
Este trabajo investigará cómo la actuación del Tribunal de Contrataciones del
Organismo Supervisor de las Contrataciones del Estado (OSCE) como órgano
sancionador afecta el principio del debido proceso, tanto en su dimensión formal
como sustantiva. El estudio se centrará en el análisis del debido procedimiento
sancionador en las contrataciones con el Estado, tomando como eje la Ley Nº
27444, Ley del Procedimiento Administrativo General (LPAG), y su relación con
las garantías del debido proceso. Además, se hará un análisis sobre la
separación de funciones de la fase instructora y la fase sancionadora en
instituciones peruanas como la SUTRAN y SERVIR.
El objetivo principal será determinar si la función dual del Tribunal del OSCE,
como órgano instructor y sancionador, vulnera las garantías del debido proceso
establecidas en la LPAG, como el derecho de defensa, el plazo razonable y la
debida motivación. Para lograrlo, se empleará un análisis jurídico doctrinal,
evaluando la estructura organizacional del OSCE y cómo esta influencia en la
imparcialidad y objetividad de los procedimientos sancionadores.
La importancia de este trabajo radica en identificar posibles vulneraciones al
debido proceso en un ámbito crucial como las contrataciones públicas,
proponiendo mejoras normativas para garantizar un sistema sancionador más
justo y transparente. Esto contribuirá no solo al fortalecimiento de la
institucionalidad del OSCE, sino también a una mayor protección de los derechos
fundamentales en el marco de los procedimientos sancionadores
administrativos.
This research will explore the impact of the actions taken by the Contracting Tribunal of the Supervisory Body for State Contracting (OSCE) as a sanctioning authority on the principle of due process, examining both its formal and substantive aspects. The analysis will center on the sanctioning due process in state contracting, with a focus on Law No. 27444, the General Administrative Procedure Law (LPAG), and its connection to the guarantees inherent in due process. The primary aim is to assess whether the dual role of the OSCE Tribunal, functioning both as an investigative and sanctioning body, compromises the due process guarantees outlined in the LPAG, including the rights to defense, reasonable timeframes, and proper justification. To address this, the study will employ a doctrinal and jurisprudential legal analysis, examining the organizational structure of the OSCE and its impact on the impartiality and objectivity of the sanctioning processes. The importance of this work lies in identifying possible violations of due process in a crucial area such as public procurement, proposing regulatory improvements to ensure a fairer and more transparent sanctioning system. This will contribute not only to the strengthening of the institutional framework of the OSCE, but also to a greater protection of fundamental rights in the framework of administrative sanctioning procedures.
