Sobre la Convención americana y la pena de muerte: De la necesidad de denunciar el Pacto de San José para ampliar causales de pena capital y las consecuencias jurídicas de esta decisión

Abstract
El Perú ratificó la Convención Americana sobre Derechos Humanos el 12 de
julio de 1978. Entre las diversas obligaciones a las que quedó sometida el Estado
peruano, destaca la prohibición de aumento de causales para implementar la pena de
muerte para delitos no contemplados al momento de la ratificación. Pese a su adopción,
esta disposición ha seguido generando diversas opiniones sobre la posibilidad de un
aumento a causales, planteándose su implementación a través de un retiro parcial y la
denuncia sobre el Pacto de San José. Ante las constantes propuestas de ampliación de
causales previstas en nuestra legislación para la pena de muerte, evaluaremos la
posibilidad de hacerlo en el marco la legislación vigente y la o las medidas que habría
que adoptar de quererse implementar efectivamente.
Peru ratified the American Convention on Human Rights on July 12, 1978. Among the various obligations to which the Peruvian State was subjected, it highlights the prohibition of increased grounds to implement the death penalty for crimes not contemplated at the time of ratification. Despite its adoption, this provision has continued to generate various views on the possibility of a causal increase, with its implementation raised through a partial withdrawal and denunciation of the San José Pact. Faced with the constant proposals for the extension of causes provided for in our legislation for the death penalty, we will assess the possibility of doing so within the framework of the legislation in force and the measures to be taken if it were to be implemented effectively.
