La caducidad de la hipoteca constituidas en favor de empresas del sistema financiero

Abstract

Las hipotecas constituidas en favor del sistema financiero se encuentran exentas de la aplicación de la ley 26639, en tanto la Ley del Sistema Financiero prohíbe su aplicación de forma expresa con la finalidad de proteger las hipotecas que se constituyen para garantizar el cumplimiento del pago de los créditos otorgados por bancos, cajas o cualquier entidad financiera. Ante esta situación, el presente trabajo plantea una visión distinta en la que la hipoteca es una forma de garantizar un crédito, pero no de forma indefinida o indeterminada, en la que solo sea levantada por las causales establecidas por el artículo 1122° del Código Civil, sin importar el transcurso del tiempo desde el vencimiento de la obligación, sino que intenta identificar cuales serían las problemáticas en caso se permitiese la existencia de hipotecas de forma indeterminada en las partidas registrales. En ese sentido, a lo largo de este artículo se justificará el porqué si se debe aplicar la figura de la caducidad en hipotecas constituidas en favor de empresas del sistema financiero.

Mortgages constituted in favor of the financial system are exempt from the application of Law 26639, while the Financial System Law expressly prohibits its application with the purpose of protecting mortgages that are constituted to guarantee compliance with the payment of the credits granted by banks, savings banks or any financial entity. Given this situation, this work proposes a different vision in which the mortgage is a way of guaranteeing a credit, but not in an indefinite or indeterminate manner, in which it is only lifted for the reasons established by article 1122 of the Civil Code. , regardless of the passage of time since the expiration of the obligation, but rather attempts to identify what the problems would be if the existence of indefinite mortgages were allowed in the registry entries. In that sense, throughout this article we will justify why the figure of expiration should be applied to mortgages established in favor of companies in the financial system.
