Entre la espada y las barreras: hacia una modificación de los efectos particulares de las barreras irrazonables

Abstract

En muchas ocasiones, el crecimiento económico y social de un país se ve mermado por medidas ilegales o arbitrarias, desincentivando la inversión económica o reduciendo las opciones de la población para acceder a diversos servicios en el sector privado. Es en estas situaciones que la Comisión de Eliminación de Barreras Burocráticas (CEB) y Sala de Eliminación de Barreras Burocráticas (SEL) del Indecopi juegan un rol sumamente importante al momento de eliminar estas barreras y así asegurar la libertad de empresa y el acceso y la permanencia en el mercado. Este rol es aún más imprescindible cuando, colateralmente, estas barreras ilegales o arbitrarias atentan no solo contra los intereses de agentes económicos, sino también contra intereses públicos. Es por ello que, en el presente artículo, analizaremos el impacto de los efectos de la declaración de una barrera burocrática irrazonable, para establecer si los efectos que tienen actualmente conforme al Decreto Legislativo No. 1256, son suficientes para poder alcanzar el fin de la norma, que es asegurar la libertad de empresa y el acceso al mercado y, a partir de ello, analizar y proponer una nueva redacción del artículo que regula dicho supuesto.

On many occasions, the economic and social growth of a country is undermined by illegal or arbitrary measures, discouraging economic investment or reducing the population's options to access various services in the private sector. It is in these situations that the Commission for the Elimination of Bureaucratic Barriers (CEB) and the Room for the Elimination of Bureaucratic Barriers (SEL) of Indecopi play an extremely important role in eliminating these barriers and thus ensuring freedom of enterprise and access to and permanence in the market. This role is even more essential when, collaterally, these illegal or arbitrary barriers threaten not only the interests of economic agents, but also public interests. That is why, in this article, we will analyze the impact of the effects of the declaration of an unreasonable bureaucratic barrier, in order to establish whether the effects that currently have under Legislative Decree No. 1256 are sufficient to achieve the purpose of the rule, which is to ensure freedom of enterprise and access to the market and, based on this, analyze and propose a new wording of the article that regulates such assumption.
