Afectaciones a los Principios Registrales e incongruencias en el Código Civil a raíz de la Ley N° 30313

Abstract
En nuestro país, numerosas personas fueron despojadas de su derecho de propiedad
a causa de redes criminales que utilizaron vacíos legales para perpetrar sus actos.
Por ello, en el año 2015 se promulgó la Ley N° 30313, la cual buscó combatir el fraude
inmobiliario en el Perú al crear la oposición en el procedimiento de inscripción registral
en trámite y la cancelación de asientos registrales, ambos casos por suplantación de
identidad y falsificación de documentos. Para tales efectos, entre otras disposiciones,
se modificaron diversos artículos del Código Civil y del Decreto Legislativo Nº 1049.
La finalidad del presente artículo es demostrar que tales modificaciones al Código
Civil afectaron nuestro sistema registral, la seguridad jurídica de nuestro
ordenamiento y; también se afectaron diversos principios registrales, como lo son el
principio de legitimación, el principio de calificación y el principio de Fe pública
Registral. Asimismo, determinar cómo estás modificaciones generaron que exista una
contradicción entre los artículos 2013° y 2014° del Código Civil.
La investigación está fundamentada con resoluciones del Tribunal Registral,
Sentencias del Tribunal Constitucional, Jurisprudencia, así como con Doctrina
nacional e internacional. Asimismo, se procedió a analizar la regulación que tiene
nuestro ordenamiento en el Código Civil y Reglamento General de los Registros
Públicos.
In our country, many people were deprived of their property rights due to criminal networks that used legal loopholes to perpetrate their acts. Therefore, in 2015, Law No. 30313 was enacted, which sought to combat real estate fraud in Peru by creating the opposition in the procedure of registration in process and the cancellation of registration entries, both cases for identity fraud and falsification of documents. For such purposes, among other provisions, several articles of the Civil Code and Legislative Decree No. 1049 were modified. The purpose of this article is to demonstrate that such modifications to the Civil Code affected our registry system, the legal security of our legal system and also affected several registry principles, such as the principle of legitimacy, the principle of qualification and the principle of public faith in the registry. Likewise, to determine how these modifications generated a contradiction between articles 2013° and 2014° of the Civil Code. The research is based on resolutions of the Registry Court, Judgments of the Constitutional Court, Jurisprudence, as well as national and international doctrine. Likewise, we proceeded to analyze the regulation of our system in the Civil Code and the General Regulations of the Public Registries.
