Abstract
El presente artículo académico revisa el régimen jurídico de la potestad
sancionadora de la Administración Pública y pone en relieve a los principales problemas
que enfrenta su actual regulación. Asimismo, compara el modelo constitucional peruano
con modelos propios de la región (Chile y Colombia) y de Europa (España), con el
objetivo de analizar la pertinencia de realizar posibles cambios constitucionales para
reforzar el régimen establecido en la Ley.
This academic article examines the legal framework of the punitive power of the Public Administration and highlights the main problems faced by its current regulation. Additionally, it compares the Peruvian constitutional model with those of the region (Chile and Colombia) and Europe (Spain), aiming to analyze the relevance of implementing potential constitutional changes to strengthen the regime established in the Law.
