Alcances y límites de la prohibición de reforma peyorativa en la impugnación de actos administrativos

Abstract
En la presente investigación se abordará una problemática en torno una de las figuras
jurídicas más importantes relacionada a la impugnación de actos administrativos. Nos
estamos refiriendo a la interdicción o prohibición de reforma peyorativa. A lo largo del
trabajo, sostendremos que la aplicación de esta garantía, creada precisamente para
favorecer al recurrente, no debería estar limitada únicamente a los procedimientos
administrativos sancionadores.
Si bien dicho planteamiento contradice a la literalidad del artículo 258.3 del TUO de la
Ley N° 27444, así como a la práctica administrativa peruana que se ha venido llevando
a cabo a lo largo de los años, consideramos que existen fundamentos doctrinarios,
constitucionales y jurisprudenciales para sustentar una interpretación amplia y extensiva
de la llamada “non reformatio in peius”. En realidad, dicha figura jurídica también debería
poder ser alegada cuando se recurren actos administrativos en cualquier tipo de
procedimiento, a excepción del trilateral, al cual se aplican principios y garantías
especiales.
This research will address a problem related to one of the most important legal figures related to the impugnation of administrative acts. We are referring to the interdiction or prohibition of pejorative reform. Throughout this paper, we will argue that the application of this guarantee, created precisely to favour the appellant, should not be limited only to administrative sanctioning procedures. Although such an approach contradicts the wording of article 258.3 of the TUO of Law No. 27444, as well as the Peruvian administrative practice that has been carried out over the years, we consider that there are doctrinal, constitutional and jurisprudential grounds to support a broad and extensive interpretation of the “non reformatio in peius”. In fact, this legal figure should also be invoked when appealing administrative acts in any type of procedure, with the exception of trilateral procedures, to which special principles and guarantees apply.
