El impedimento para que los oficiales de las Fuerzas Armadas contraten con el Estado

Abstract

La infracción administrativa de contratar con el Estado estando impedido, conforme al artículo 50 de la Ley 30225, vinculada con el artículo 11 de la misma normativa, que regula los impedimentos de los servidores públicos, en específico los oficiales de las Fuerzas Armadas, según su estatus militar, ya sea en actividad, disponibilidad o retiro. La legislación vigente en materia de contrataciones resulta insuficiente, dado que no establece con claridad si dicho impedimento se extiende hasta los oficiales de rangos superiores, que en ejercicio de sus funciones tiene o tuvieron poder decisión o información privilegiada, que a pesar de su clasificación militar gozan de prerrogativas propias de la Institución donde pertenecen.The administrative infraction of contracting with the State being impeded, according to Article 50 of Law No. 30225, is linked to Article 11 of the same law, which regulates the impediments of public servants, specifically the officers of the Armed Forces, who are categorized according to their military situation of activity, availability and retirement. The current contracting regulations are not sufficient insofar as they do not specify whether the impediment extends to officers of higher ranks, who in the exercise of their functions have or had decision-making power or privileged information, who even in a situation of availability or retirement enjoy the prerogatives of the Institution to which they belong.
