Tratamiento del matrimonio homosexual en el sistema legal peruano a partir de la teoría de los enunciados jurídicos

Abstract
Este artículo tiene por finalidad analizar el tratamiento del matrimonio
homosexual, desde la teoría de los enunciados jurídicos. Con tal objetivo, en la
primera sección se ha desarrollado las diferencias entre. Reglas regulativas y
constitutivas. En la segunda sección, se ha tratado sobre las lagunas, la laguna
normativa y la laguna axiológica. En la tercera sección se ha tratado sobre las
técnicas de interpretación, destacándose la analogía y los principios. En la cuarta
sección se ha procedido a examinar las normas relacionadas con el matrimonio
civil contenidas en la Constitución Política del Perú, el código civil y principales
tratados y convenios aplicables al caso. Finalmente, en la sección quinta se ha
llegado a las siguientes conclusiones: 1) Desde el ángulo de la teoría de los
enunciados jurídicos, el artículo 234º del Código Civil no es una regla regulativa,
sino una regla constitutiva. Por tanto, no prohíbe el matrimonio homosexual; sin
embargo, tampoco lo regula, 2) Al no existir regulación jurídica del matrimonio
homosexual, tal supuesto de hecho constituye una laguna normativa; 3)
Aplicando la técnica de integración para resolver lagunas normativas, a través
de principios siguiendo la propuesta de Ruiz Manero,1 se llega a la conclusión
que del balance de principios relevantes debe crearse una regla que autorice a
la pareja de homosexuales contraer matrimonio civil. Asimismo, siguiendo la
tendencia jurisprudencial de países latinoamericanos como Ecuador y la
interpretación de la Convención Americana contenida en la “Opinión Consultiva
24/17; así como lo resuelto en el Caso Atala Riffo y Niñas contra el gobierno
chileno2 podemos concluir afirmando que el matrimonio entre personas del
mismo sexo se encuentra permitida.
This article aims to analyze the treatment of homosexual marriage from the theory of legal statements. With this objective, in the first section the differences between regulatory and constitutive rules have been developed. In the second section, the gaps, the normative gap and the axiological gap have been discussed. In the third section, the interpretation techniques have been discussed, highlighting the analogy and the principles. In the fourth section, the norms related to civil marriage contained in the Political Constitution of Peru, the civil code and the main treaties and agreements applicable to the case have been examined. Finally, in the fifth section the following conclusions have been reached: 1) From the angle of the theory of legal statements, article 234 of the Civil Code is not a regulatory rule, but a constitutive rule. Therefore, it does not prohibit homosexual marriage; however, it does not regulate it either, 2) Since there is no legal regulation of homosexual marriage, such a factual situation constitutes a normative gap; 3) Applying the integration technique to resolve regulatory gaps, through principles following the proposal of Ruiz Manero, we reach the conclusion that the balance of relevant principles must a rule that authorizes homosexual couples to enter into civil marriage should be created. Likewise, following the jurisprudential trend of Latin American countries such as Ecuador and the interpretation of the American Convention contained in the “Advisory Opinion 24/17; as well as what was resolved in the case of Atala Riffo and Girls against the Chilean government, we can conclude by affirming that marriage between persons of the same sex is permitted.
