La corrupción sexual: fundamentos para su regulación en el sistema penal peruano

Resumen
La corrupción sexual ha constituido históricamente una forma silenciosa de
corrupción, permaneciendo invisible y sin reconocimiento como fenómeno
específico dentro de los marcos de violencia de género y corrupción. Esto ha
generado que a las víctimas, principalmente mujeres en situaciones de
vulnerabilidad, se les niegue sistemáticamente su derecho de acceso a la
justicia, así como, a la obtención de una reparación integral, debido a que la gran
mayoría de operadores de justicia desconocen de la existencia de esta forma de
corrupción vinculada a la violencia de género. En este contexto, el objetivo de la
presente investigación es visibilizar el impacto que tiene este fenómeno, así
como, determinar la necesidad de regular la corrupción sexual en el sistema
penal peruano, con la finalidad de reconocer el estatus de la víctima en el marco
procesal y garantizar una adecuada reparación del daño ocasionado por esta
conducta delictiva. Finalmente, se concluye que si bien es necesaria una
regulación específica de la corrupción sexual, el trabajo no se agota en ello, es
imperativo explorar medidas complementarias que contribuyan a erradicar la
impunidad en estos casos.
Sexual corruption has historically constituted a silent form of corruption, remaining invisible and unrecognized as a specific phenomenon within the framework of gender-based violence and corruption. This has meant that the victims, mainly women in vulnerable situations, are systematically denied their right to access to justice, as well as to obtain comprehensive reparation, because the vast majority of justice operators are unaware of the existence of this form of corruption linked to gender-based violence. In this context, the objective of this research is to make visible the impact of this phenomenon, as well as to determine the need to regulate sexual corruption in the Peruvian penal system, in order to recognize the status of the victim in the procedural framework and to guarantee an adequate reparation of the damage caused by this criminal conduct. Finally, it is concluded that although a specific regulation of sexual corruption is necessary, the work is not exhausted in it, it is imperative to explore complementary measures that contribute to eradicate impunity in these cases.
