Abstract
El presente trabajo tiene como finalidad el estudio y análisis de la institución de
la nulidad de oficio en el derecho administrativo peruano. Para ello, se llevará a
cabo un análisis de la relación de esta con los principios de legalidad, y
predictibilidad y confianza legítima. Asimismo, se explicará cómo la
Administración, haciendo uso de su potestad de autotutela, puede anular actos
administrativos con vicios trascendentes con la finalidad de garantizar el respeto
a los principios antes mencionados. De igual modo, se abordará también los
límites y condiciones que posee este procedimiento de revisión de oficio que
sirve como garantía para los derechos de los administrados y la estabilidad de
los actos emitidos. La investigación examinará, además, el derecho de los
ciudadanos a formular denuncias informativas como un mecanismo
complementario para incentivar la actuación de la Administración. En base a este
derecho, los administrados podrán, en base a su deber de colaboración, advertir
a las entidades de la Administración Pública sobre vicios trascendentes que
afectan a los actos emitidos por ellas, impulsando de este modo a la
Administración a iniciar el procedimiento de revisiones de oficio cuando
corresponde. Para ello, es necesario comprender las diferencias que posee la
nulidad de oficio y los otros mecanismos de revisión administrativa, como la
rectificación de errores y la revocación, enfatizando la necesidad de que cada
uno se aplique según sus criterios específicos. Finalmente, las denuncias
informativas se presentan como mecanismos que ayudan a contribuir en la
eficacia de los actos administrativo permitiendo el fortalecimiento de la confianza
en la Administración.
The purpose of this paper is to study and analyze the institution of ex officio nullity in Peruvian administrative law. To this end, an analysis will be made of its relationship with the principles of legality, predictability and legitimate trust. Likewise, it will be explained how the Administration, making use of its power of self-protection, can annul administrative acts with transcendental defects in order to guarantee the respect of the aforementioned principles. Likewise, it will also address the limits and conditions of this ex officio review procedure, which serves as a guarantee for the rights of the persons administered and the stability of the acts issued. The research will also examine the right of citizens to file informative complaints as a complementary mechanism to encourage the actions of the Administration. On the basis of this right, the administrated may, based on their duty of collaboration, warn the entities of the Public Administration about transcendental defects affecting the acts issued by them, thus prompting the Administration to initiate the procedure of ex officio revisions when appropriate. To this end, it is necessary to understand the differences between ex officio nullity and the other administrative review mechanisms, such as rectification of errors and revocation, emphasizing the need for each one to be applied according to its specific criteria. Finally, informative complaints are presented as mechanisms that help to contribute to the effectiveness of administrative acts, allowing the strengthening of trust in the Administration.
