Abstract
El presente trabajo aborda la reforma en la función pública y la implementación del
servicio civil. En esta ocasión, la función pública es tratada a partir de los regímenes
regulados por los Decretos Legislativos Nos 276, 728 y 1057, que pese a ninguna de
ellas representa un régimen referente para la reforma del Estado en lo que respecta
al empleo público, a diferencia de la Ley N° 30057, Ley del Servicio Civil (en adelante,
L30057); el contraste entre los cuatro regímenes nos sirve para comentar las
bondades de la instalación del servicio civil en nuestro ordenamiento y su gestación
como política de Estado.
Asimismo, aproximamos el rol de la Autoridad Nacional del Servicio Civil - SERVIR y
su ámbito de actuación buscando conocer sus funciones y logros en la instauración
del servicio civil como parte de su impulso y defensa. Adoptando una posición
imparcial dedicamos un apartado al proceso de tránsito de las entidades iniciado hace
más de una década y el descrédito en la ciudadanía por su lenta aplicación en la
Administración Pública, sin dejar de mencionar el importante alcance logrado con la
promulgación del Decreto Legislativo N° 1602.
Por último, la capacitación del personal es glosada a partir del marco normativo
vigente así como de la tensa discusión que ha generado su aplicación y las
consecuencias de ella en las relaciones laborales.
This paper addresses the reform in public service and the implementation of the civil service. In this context, public service is examined through the regimes regulated by Legislative Decrees Nos. 276, 728, and 1057, none of which represent a benchmark for the state reform regarding public employment, in contrast to Law No. 30057, the Civil Service Law (hereinafter, L30057). The comparison of these four regimes helps us to discuss the advantages of establishing civil service in our legal system and its development as a state policy. Furthermore, we approach the role of the National Civil Service Authority - SERVIR and its scope of action, aiming to understand its functions and achievements in the establishment of the civil service as part of its promotion and defense. Adopting an impartial stance, we dedicate a section to the process of transition within entities, which began over a decade ago, and the discredit it has faced among citizens due to its slow implementation in Public Administration, without overlooking the significant progress made with the enactment of Legislative Decree No. 1602. Finally, the training of personnel is discussed based on the current regulatory framework, as well as the intense debate surrounding its application and the consequences it has had on labor relations.
