Abstract
La contratación pública es esencial en la gestión estatal moderna, sirviendo no
solo para adquirir bienes y servicios, sino también para implementar políticas
públicas y fomentar el desarrollo económico. En Perú, la fase de ejecución
contractual es crítica, ya que en ella se encuentran los intereses del Estado y los
contratistas, y plantea dos problemas jurídicos clave.
El primero es la determinación de la naturaleza jurídica de los actos emitidos por
las entidades públicas durante esta fase. La Ley de Contrataciones del Estado
peruano suscita dudas sobre si dichos actos pertenecen al derecho público,
privado o una categoría híbrida, lo cual afecta la seguridad jurídica y
predictibilidad en las relaciones contractuales. Esto es fundamental para definir
los procedimientos de impugnación, plazos y las instancias competentes para
resolver disputas, evitando demoras y asegurando la continuidad de obras y
servicios públicos.
El segundo problema se enfoca en la normativa aplicable a estos actos,
considerando no solo la Ley de Contrataciones y su reglamento, sino también
otras disposiciones legales peruanas. Estos aspectos son relevantes no solo en
teoría, sino también en la práctica, ya que su adecuada comprensión facilita una
gestión contractual eficaz y protege el interés público. Este análisis permite
explorar la relación entre derecho público y privado en la contratación estatal y
los desafíos enfrentados por las entidades y contratistas para lograr una
ejecución contractual eficiente y equitativa.
Public procurement is essential in modern state management, serving not only to acquire goods and services, but also to implement public policies and promote economic development. In Peru, the contractual execution phase is critical, as it is where the interests of the State and the contractors meet, and raises two key legal issues. The first is the determination of the legal nature of the acts issued by public entities during this phase. The Peruvian State Contracting Law raises doubts as to whether such acts belong to public law, private law or a hybrid category, which affects legal certainty and predictability in contractual relations. This is essential in order to define the challenge procedures, deadlines and competent instances to resolve disputes, avoiding delays and ensuring the continuity of public works and services. The second problem focuses on the regulations applicable to these acts, considering not only the Procurement Law and its regulations, but also other Peruvian legal provisions. These aspects are relevant not only in theory, but also in practice, since their proper understanding facilitates effective contract management and protects the public interest. This analysis explores the relationship between public and private law in government contracting and the challenges faced by entities and contractors to achieve efficient and equitable contract execution.
