La fiscalización laboral y las medidas correctivas: una interpretación crítica desde las bases del Procedimiento Administrativo General

Abstract

Este Informe tiene como objetivo principal estudiar las normas que regulan el objeto, finalidad y características de la fiscalización laboral, las actas de fiscalización y las medidas correctivas bajo la perspectiva y alcances de la Ley del Procedimiento Administrativo de Trabajo. Todo ello con la finalidad de identificar si las disposiciones que rigen la fiscalización en el sector trabajo son acordes con la naturaleza de la fiscalización laboral según la norma general o si, por el contrario, existen discrepancias que ameritan una reforma legislativa.

This report aims primarily to study the regulations governing the object, purpose, and characteristics of labor inspection, inspection records, and corrective measures from the perspective and scope of the Law of Administrative Labor Procedure. All of this with the purpose of identifying if the provisions governing inspection in the labor sector are in line with the nature of labor inspection according to the general norm, or if, on the contrary, there are discrepancies that warrant legislative reform.
