Poder y ejercicio del derecho al agua en contextos mineros: el caso de Cerro Verde en Arequipa

Abstract

En los últimos 15 años la Sociedad Minera Cerro Verde ha construído una serie de infraestructuras de agua a lo largo de la cuenca del río Chili en Arequipa. Estas obras se engloban en una política institucional llamada el Círculo Virtuoso del Agua, cuyo objetivo es contribuir a la eficiencia hídrica en la cuenca con obras de represamiento, tratamiento y potabilización. La presente tesis analiza las condiciones bajo las que se ejerce el derecho al agua en la cuenca del Chili en Arequipa a la luz de los convenios entre Cerro Verde y las autoridades por el agua. El objetivo es analizar si los desequilibrios de poder entre empresa minera y actores subnacionales impactan en la capacidad de ejercer el derecho al agua en contextos mineros. A partir del análisis a los arreglos de la gobernanza ambiental en la minería se determina que la estrategia de Cerro Verde cumple con cerrar las brechas de infraestructura de agua y el acceso a ciertos usuarios. Sin embargo, el énfasis no es puesto en mejorar la situación de inequidad en la distribución del recurso o las injusticias hídricas. Por otro lado, los acuerdos sirven para consolidar el modelo de toma de decisión en el sector minero y, así, impulsar la presencia de esta actividad en la región. Finalmente, los acuerdos se soportan en una construcción institucional altamente dependiente de formas de gestión del agua previas a la introducción de la gran minería, haciendo que las condiciones de Cerro Verde sean difícilmente repetibles en otros contextos mineros.

For the last 15 years, Sociedad Minera Cerro Verde (SMCV) has financed and/or built a series of water infrastructure projects across the Chili river basin in the province of Arequipa. These projects are backed by a corporate water efficiency policy called the “Virtuous Cycle of Water” that involves different interventions across the basin including water transfers, dams and black water treatment facilities. SMCV wielded the notion of water efficiency to generate a consensus among the decision makers at the national and subnational level. However, SMVC’s water efficiency policy isn’t neutral and is preceded by a series of agreements with different stakeholders across a fixed period that coincides with the two expansion phases of its operations. This thesis discusses the influence of participation and power dynamics in the exercise of the water rights as a human right in a mining context. Through the analysis of the environmental governance arrangements of mining in the region we find that SMCV strategy focuses in closing the gap of water accessibility and quality for stakeholders that are represented in the river basin decision making spaces. Nevertheless, the emphasis is not put on reducing preexisting conditions of water inequality. On the other hand, the agreements serve to consolidate a decision-making model that privileges the mining company and the presence of this activity in the region. Finally, the governance arrangement is highly dependent on the local institutions of water management, which even precede big mining, making the conditions of SMCV strategy hardly replicable in other contexts.
