Informe sobre Sentencia o Resolución Nº 2025-2019/SPC-INDECOPI
Abstract
El presente informe analiza la resolución Nª 2025-2019/SPC-INDECOPI, emitida por la Sala
Especializada de Protección al Consumidor donde se resuelve sancionar al Banco
Interamericano de Finanzas por infringir el mandato de no discriminación en el consumo en
su servicio de otorgamiento de créditos hipotecarios y el deber de idoneidad en su servicio
de tarjetas de crédito. La presente es una resolución importante porque aplica un cambio de
criterio en la jurisprudencia del Indecopi de cómo ha de interpretarse la institución de la no
discriminación en el consumo. Por ello, además de analizar la infracción al deber de
idoneidad y si era o no competente el Indecopi para fiscalizar y sancionar, analizo,
principalmente, si existe un adecuado manejo de la no discriminación en el consumo y
sostengo como opiniones principales que el trato diferenciado del Banco no responde a una
causa objetiva y razonable y que el cambio de criterio en la jurisprudencia del Indecopi no
es adecuado para tutelar el mandato de no discriminación. Finalmente, concluyo,
principalmente, que sí se ha constituido una infracción al mandato de no discriminación en
el consumo porque se ha menoscabado el goce o ejercicio de un derecho en razón de un
motivo prohibido de discriminación y sin existir una causa objetiva y razonable que explique
el trato diferenciado del Banco.
