Escuela LGB + El mandato constitucional para implementar un currículo educativo nacional que incorpore temática transversal sobre diversidad de orientación sexual

Abstract

Este trabajo plantea que a partir de la Constitución Política del Perú de 1993 se puede justificar la existencia de un mandato del Estado para implementar un currículo educativo nacional que incluya transversalmente temática sobre diversidad sexual orientada a erradicar la discriminación por orientación sexual en y desde la escuela. Primero, la tesis parte del paradigma del constitucionalismo contemporáneo de los derechos y la teoría de la argumentación jurídica, marco a partir del cual se puede estructurar un discurso sobre derechos fundamentales. Sobre esta base, se plantean premisas generales del derecho a la igualdad y el derecho a la educación reconocidos en la Constitución peruana que permitirán justificar la conclusión. Segundo, como parte de dicho discurso, se presenta una visión panorámica general de la teoría sobre la orientación sexual, la discriminación por orientación sexual y su tratamiento legal y jurisprudencial en el mundo. El trabajo examina luego los estudios enfocados en la problemática LGB+ en la escuela y la propuesta de un currículo inclusivo como requisito de una educación para todos. Tercero, en base a las premisas filosóficas, constitucionales y educacionales indicadas, la hipótesis de trabajo termina siendo validada.

This dissertation defends that, based on the Peruvian Constitution of 1993, it is possible to justify that the State has a mandate to implement a national curriculum that includes content on sexual orientation diversity, aimed towards the eradication of discrimination in and from the school. First, it is argued that contemporary constitutionalism and the theory of legal argumentation serve as a proper framework to structure a discourse on fundamental rights. On this basis, the general premises of the right to equality and the right to education recognized on the Peruvian Constitution are outlined. Second, the dissertation presents a general overview on the theories of sexual orientation and the legal treatment of discrimination based on sexual orientation in the world. Afterwards the studies on the problems of LGB children in school are examined as well as the proposal of an inclusive curriculum as a requirement of an education for all. Third and finally, based on the philosophical, constitutional and educational premises abovementioned the investigation hypothesis is validated.
