dc.description.abstractLa tesis desarrolla la hipótesis de que todos los actos de corrupción violan, directa o indirectamente, derechos humanos. Sobre la base de una definición operativa construida en función de la doctrina, la investigación considera que los actos de corrupción pueden configurar, de por sí, violaciones de derechos (violación directa), o ser la causa que conduce a la violación (violación indirecta). Ello sucede en todos los casos y se comprueba al constatar que cada acto corrupto representa una violación del derecho a la igualdad y no discriminación, así como vulneraciones de los Principios del Buen Gobierno formulados por Naciones Unidas, cuyo contenido son, asimismo, derechos fundamentales que terminan siendo afectados. Se descarta la existencia de vulneraciones remotas de derechos humanos, como alega un sector de la doctrina. Para probar el argumento —cuya conclusión es la hipótesis— se recurre, primero, a la Lógica Deductiva de Predicados y se construye un silogismo, cuya validez es verificada formalmente. Luego, se corrobora la validez del argumento a través del procedimiento contemplado por Robert Alexy en su Teoría del Discurso Racional: Discurso Práctico General, Argumento Jurídico y Argumento Dogmático, derivadas de las tesis de Jürgen Habermas. El argumento e hipótesis de la investigación es verificado formal y materialmente, y su racionalidad es constatada. La hipótesis es ilustrada con diversos casos hipotéticos y uno de la realidad peruana.es_ES
dc.description.abstractThis thesis elaborates the hypothesis that all acts of corruption can be considered direct or indirect violations of human rights. Using an operational definition based on doctrine, this research considers that acts of corruption may constitute violations of rights (direct violation), or be the cause that leads to the violation (indirect violation). This occurs in all acts and can be tested through the confirmation that each act of corruption represents a violation of the right to equality and non-discrimination, as well as breaches of the Attributes of Good Governance proposed by the United Nations (UN), which are constituted by fundamental rights that are, ultimately, also violated. The existence of remote violations, alleged by some literature, is ruled out. In order to test the argument whose conclusion is the hypothesis, the following procedures are used: first, Predicate Logic, from which a syllogism is built and whose validity is formally verified. Then, the validity of the argument is verified through the procedures proposed by Robert Alexy in his Theory of Rational Discourse: General Practical Discourse, Juridical Argument, and Dogmatic Argument, all of which are derived from the Discourse Ethics of Jürgen Habermas. The argument and hypothesis of this study: all acts of corruption violate, whether directly or indirectly, human rights. This phenomenon can be formally and materially verified and validated, and its rationality ascertained. Finally, the hypothesis is illustrated with several hypothetical cases and one real case from the Peruvian experience.es_ES
