Informe jurídico sobre la Casación 6619-2021: intereses moratorios de los pagos a cuenta del Impuesto a la Renta
Abstract
En el presente informe jurídico se analiza la problemática asociada a la
aplicación de intereses moratorios generados por la modificación del coeficiente
para el cálculo de los pagos a cuenta del Impuesto a la Renta.
Existen posturas divergentes en torno a este tema, en los diferentes niveles de
los órganos resolutivos administrativos y en sede judicial, lo que ha
desembocado en la emisión de diversas casaciones como la 27444-2018, la
4392-2013, y la Casación materia de análisis en el presente informe. No
obstante, con ello no se ha logrado establecer un criterio que otorgue seguridad
o que esclarezca la problemática.
Una posición, sostiene que sí se deben cobrar intereses moratorios a los pagos
a cuenta del IR tras la modificación del coeficiente, generado ya sea por una
fiscalización posterior o por una declaración jurada rectificatoria; dado a que, se
ha producido una omisión que rompe con el requisito de pago oportuno. La
posición contraria, asegura que no corresponde la aplicación de estos intereses,
dado que, si el contribuyente cumplió con determinar los pagos a cuenta con los
elementos de cálculo presentes al momento del abono, se ha cumplido con ello
de forma oportuna.
En ese sentido, corresponde analizar las principales figuras jurídicas que
