Informe Jurídico sobre la Sentencia del Tribunal Constitucional N° 868/2021, recaída en el Expediente N° 00003-2020-PCC/TC

Abstract

La presente investigación jurídica tiene como propósito realizar un análisis sobre la Sentencia del Tribunal Constitucional, recaída en el Expediente Nro. 00003-2020- PCC/TC, sobre conflicto competencial, entre la Municipalidad de San Isidro (en adelante, MSI) contra el Ministerio de Vivienda, Construcción y Saneamiento (en adelante, MVCS). Para ello, se analizan la distribución y asignación de competencias que dispone la Constitución Política y leyes infra constitucionales. Dicho análisis contemplará entre otras secciones, la realización de un test competencial. Para ello, se analizarán conceptual y normativamente materias referidas a la edificación de viviendas de interés social (en adelante, VIS), por el MVCS, competencias en planificación urbana a cargo de los gobiernos locales, la rectoría del MVCS en materia de vivienda y políticas públicas en la misma, así como también, su aplicación en el marco del Estado unitario y descentralizado.

The purpose of this legal report is to analyze the ruling of the Constitutional Tribunal in Case No. 00003-2020- PCC/TC, regarding the conflict of competence between the Municipality of San Isidro and the Ministry of Housing, Construction and Sanitation. For this purpose, the distribution and assignment of competences provided by the Political Constitution and infra-constitutional laws are analyzed. This analysis will include, among other sections, a competency test. To this end, we will analyze conceptually and normatively matters related to the construction of social housing by the MVCS, urban planning competencies of local governments, the steering role of the MVCS in housing and public policies in this area, as well as its application in the framework of the unitary and decentralized State.
