Informe sobre Resolución 2135-2012/SC2-INDECOPI
Abstract
El presente informe aborda la Resolución 2135-2012/SC2-INDECOPI mediante la cual
se confirma la Resolución 3329-2011/CPC de primera instancia y se sanciona a Rímac
por discriminación en el consumo al haber impedido la suscripción de la hija del
denunciante al seguro “Red Salud” debido a que ella tenía Síndrome de Down.
Consideramos que Rímac actuó bajo el Principio de Legalidad pues, en el momento de la
denuncia, ninguna norma le exigía que asegure a personas con discapacidad, muy aparte
de aquello que solidariamente y de buena fe podría haber hecho. Asimismo, el obligar a
Rímac a otorgar el mismo seguro de salud para una persona con necesidades especiales,
que debe tener una mayor protección, no resulta en un servicio idóneo para dicha persona
y para cubrir sus requerimientos de salud. La seguridad social es un derecho humano,
pero también exigible a los Estados y obligar a las empresas privadas a brindar esos
servicios no es la solución. El objetivo del presente informe es probar dichas hipótesis.
En conclusión, Rímac tiene un derecho a la libertad de empresa protegido
constitucionalmente y los informes de genetistas que indican que las personas con
discapacidad representan un mayor riesgo debieron atenderse como causa objetiva para
el trato diferenciado.
