The purpose of this article is to determine if the budgetary autonomy of the Regional Councils is necessary. (i) Since 2002, our country has been in constant and progressive development of decentralization. The Political Constitution of Peru and the Decentralization Bases Law determine that regional governments as organizations have political, administrative and economic autonomy. However, the Regional Councils are a regional body which exercise normative and supervisory functions towards the Regional Governments. The Regional Councils are made up of regional councilors who represent each of the provinces of a region. (ii) The supervisory function allows the necessary controls to be carried out by the regional executive in order to determine compliance with its tasks. In order to fulfill this function, the resources assigned to the Regional Councils are subject to the availability and discretion of the governors on duty, which could be a limiting factor for the supervisory power (iii) Current regulations require reforms of a constitutional and legal nature, which would allow the Regional Councils to have budgetary independence in order to strengthen their supervisory powers through the contracting of services and acquisition of goods....

The main problem in this case is limited to determining the scope of the duty of impartiality and independence of the Higher Arbitration Council of the Chamber of Commerce of Lima, as arbitrator appointing entity. In this regard, my position goes against the ruling of the Constitutional Court that declared the amparo claim founded and therefore null and void the Resolutions issued by the Higher Arbitration Council and the award, taking the process back to the time of the appointment of arbitrator Jorge Vega Velasco . This is due to the fact that the Constitutional Court did not apply an objective criterion to be able to determine the alleged partiality and dependency of the aforementioned Council. On the contrary, it applied the theory of appearance, without basing itself on evidence duly proven in constitutional law. For the purpose of this investigation, the main instruments used are the General Arbitration Law, IBA Guidelines on conflicts of interest, Arbitration Regulations of the Arbitration Center of the Chamber of Commerce of Lima, as well as national and international doctrine on the duty of impartiality and independence....

This study aims to know the facilitating and limiting elements for the functioning of the Council of Boys and Girls of the Municipality of Lima, Management 2019. It examines the knowledge of the officials of the local government on this important space for participation and the methodological adaptations for the accompaniment of the boys and girls counselors in order to know how the opinions and/or advice of the boys and girls are incorporated into municipal management. This research is descriptive in nature and has been developed using methods linked to the qualitative approach, which allows supporting the results with the analysis of the information collected through in-depth and semi-structured interviews, direct observation forms, photographs and documentary review. Theoretical information that collects information and debates on this subject has also been incorporated. The findings around the central questions of the research allow to determine that there is a high level of knowledge, approaches and commitment of the person in charge of the operation of the Advisory Council of Boys and Girls, which facilitates the operation of this space for participation. A second facilitator for the operation of this space is the methodological and cultural adaptations for the training process and accompaniment of the boys’ and girls’ counselors, which allows those involved to feel comfortable and motivated to participate. The third facilitator is the commitment of the parents, since they are the ones who mobilize the boys and girls to the different activities they program. Finally, the fourth facilitator is the opening and positive assessment of the officials to incorporate the opinion of the children. Political will is an important facilitator, the lack of it can become a relevant limitation for the functioning of the Advisory Council. Likewise, it was found that the Advisory Council for Boys and Girls does not have a special item in the council's budget, despite the fact that this is an element considered important for the functioning of any participatory space; even so, this is not considered a factor that affects the actions of the Boys and Girls Advisory Council of the Municipality of Lima....
