La redacción típica utilizada por el legislador fue deficiente, generando con ello problemas de interpretación hermenéutica respecto a la diferencia entre ambos tipos penales. A partir de ello, el presente trabajo propone como respuesta a dicho cuestionamiento, la interpretación del elemento estructural como un componente exclusivo del delito de organización criminal y potenciador de elementos que encontramos a la vez presentes en el delito de banda criminal, aunque en una formulación simple en este último ilícito.With the enactment of Legislative Decree No. 1244, Peruvian criminal legal system incorporated two new criminal offenses to fight against organized crime: the crime of criminal organization and the crime of criminal gang, provided for in articles 317 and 317-B of the Criminal Code. The typical wording used by the legislator was deficient, thus generating problems of hermeneutic interpretation regarding the difference between the two types of crime.
