Resumen
Mediante el presente informe jurídico, se realiza un análisis crítico sobre la
posición que adopta la Corte respecto del incremento salarial efectuado a los no
sindicalizados de la empresa Palmas del Espino S.A., por los periodos del 2017
al 2021, los mismos montos que fueron previamente negociados y pactados, en
los mismos periodos, bajo convenio colectivo con el único sindicato de la
empresa de ámbito minoritario. La justificación de la Corte se centra en la
equiparación remunerativa utilizando como medio una política salarial, para
cumplir su objetivo de equilibrar las remuneraciones entre los sindicalizados y no
sindicalizados.
Bajo el análisis efectuado en la presenta investigación, se determinó que esta
posición va en contrario a lo legamente establecido conforme a los siguientes
argumentos: (1) bajo criterios objetivos y razonable como las cargas y
condiciones que sumen los afiliados y el carácter de representatividad
determinan un tratamiento diferenciado, (2) la negación colectiva es el criterio
que fundamenta la diferencia remunerativa de los sindicalizados, (3) la política
termina siendo un instrumento para neutralizar los efectos de la negociación
colectiva, (4) la evaluación del trato discriminatorio puede efectuarse desde
componentes de la remuneración como es el caso de los incrementos salariales,
y (5) los hechos demuestran que esta práctica refiere a una extensión de
beneficios indirecta, que no tiene sustento legal para su ejercicio. Esta
argumentación lleva a determinar que se configuró una afectación a la libertad
sindical del Sindicato de Trabajadores de Palma del Espino S.A.
This legal report presents a critical analysis of the Court's position regarding the salary increases granted to non-unionized employees of Palmas del Espino S.A. for the 2017–2021 period—amounts that had previously been negotiated and agreed upon during that same timeframe via a collective bargaining agreement with the company's sole, minority-status union. The Court’s reasoning centers on achieving remuneration parity through a wage policy aimed at balancing the pay of unionized and non-unionized employees. The analysis conducted in this study determined that this position runs counter to established law, based on the following arguments: (1) objective and reasonable criteria—such as the burdens and conditions assumed by union members and the nature of union representation—justify differential treatment; (2) collective bargaining is the basis for the pay differential enjoyed by union members; (3) the policy effectively serves as a tool to neutralize the impact of collective bargaining; (4) assessments of discriminatory treatment can focus on specific remuneration components, such as salary increases; and (5) the facts demonstrate that this practice constitutes an indirect extension of benefits lacking any legal basis. Consequently, it is concluded that this practice infringed upon the freedom of association of the Palmas del Espino S.A. Workers' Union.
