Análisis de la problemática en el cumplimiento de objetivos en Comisiones Multisectoriales de carácter temporal del Poder Ejecutivo vigentes entre los años 2014 y 2017

Resumen
En el presente estudio se busca desarrollar un análisis que permita conocer cómo es que
funcionan las comisiones multisectoriales que nacen con una temporalidad, asimismo y en
ese proceso estudiar por qué en la práctica superan los plazos de cierre, específicamente
estudiaremos una serie de comisiones que se encontraban vigentes entre el 2014 y el 2017.
Al respecto, es oportuno señalar que las Comisiones Multisectoriales se crean para cumplir
con el seguimiento, fiscalización, entre otros conforme lo dispone la Ley Orgánica del Poder
Ejecutivo (Ley 29158). Es así como actualmente contamos con Comisiones sectoriales,
Comisiones de naturaleza permanente y de naturaleza temporal.
En ese sentido, proponemos conocer cómo es que se generan las Comisiones de
naturaleza temporal, qué es lo que motiva a los ministerios a crear una Comisión, la
conformación de sus miembros en la medida que es el Ministerio proponente quien
considera que sectores pueden integrarla, cuál es la finalidad y en qué tiempo consideran
que pueden cumplir sus objetivos como Comisión.
A partir de disposiciones como la Ley Orgánica del Poder Ejecutivo es que encontramos
normativa adicional que ha buscado brindar herramientas necesarias para los miembros de
las Comisiones como lo regulado a través de la Directiva Nº 001-2013-PCM/SC -
Lineamientos sobre las Comisiones Multisectoriales del Poder Ejecutivo que se encontraba
vigente al momento de la elaboración de la presente tesis pero que al día de hoy se
encuentra derogada, conforme lo dispuesto en la Resolución Ministerial N° 341-2024-PCM
Diario Oficial “El Peruano”, siendo aplicable la R.N° 001-2024-PCM/SC Resolución de
Secretaría de Coordinación que crea el “Registro Unificado de Comisiones del Poder
Ejecutivo (RUCPE)” y aprueba los “Lineamientos para el ingreso de información en el
Registro Unificado de Comisiones del Poder Ejecutivo, así como el seguimiento y soporte
respectivo”.
El conocer sobre el origen y desarrollo de las comisiones Multisectoriales de naturaleza
temporal nos permitirá conocer y analizar aspectos de la gestión pública enfocados en cómo
es que el tiempo de cierre propuesto en las normas de creación es superado y ello
obedecería al perfil de los miembros que son designados para conformar las Comisiones,
la demora en contar con un Reglamento Interno, así como el no cumplimiento efectivo del
mismo ante la falta de normativa que regule puntos de responsabilidad, así como la demora
en la elaboración de un plan de trabajo, la importancia política de determinado tema en el
periodo de gobierno y la mejora del seguimiento y monitoreo de los acuerdos de las sesiones
con lo cual se pueda evaluar el cumplimiento de los objetivos para los cuales se crea, todo
lo expuesto enfocado desde lineamientos de gestión pública.
In the present study we seek to develop an analysis that allows us to know how multi-sectoral commissions that are born with a temporality work, and study why in practice they exceed the closing periods. We will study a series of commissions that were valid between 2014 and 2017. In this regard, it is appropriate to point out that the Multisector Commissions are created to comply with the monitoring, auditing, among others as provided by the Organic Law of the Executive Branch (Law 29158). Thus, we currently have Commissions sectoral Commissions, Commissions of a permanent nature and temporary nature. In this sense, we propose to know how the Commissions of a temporary nature are generated, what motivates the ministries to create a Commission, the conformation of its members to the extent that it is the proponent Ministry that considers which sectors can integrate it, what is the purpose and in what time do they consider that they can fulfill their objectives as Commission? Based on provisions such as the Organic Law of the Executive Branch, additional regulations have been established to provide the necessary tools for commission members. An example is the framework regulated under Directive No. 001-2013-PCM/SC — 'Guidelines on Multisectoral Commissions of the Executive Branch' — which was in force at the time this thesis was drafted but has since been repealed in accordance with Ministerial Resolution No. 341-2024-PCM, published in the Official Gazette El Peruano. Currently, Secretariat of Coordination Resolution No. 001-2024-PCM/SC is applicable, which establishes the 'Unified Registry of Executive Branch Commissions (RUCPE)' and approves the 'Guidelines for Data Entry into the Unified Registry of Executive Branch Commissions, as well as their Respective Monitoring and Support Knowing about the origin and development of multi-sectoral commissions of a temporary nature will allow us to know and analyze aspects of public management focused on how the closing time proposed in the rules of creation is exceeded and this would largely obey the profile of the persons that are designated to form the Commissions, the delay in having an Internal Regulation, as well as the effective non-compliance in the absence of regulations that regulate points of responsibility, as well as the delay in the preparation of a work plan, the political importance of a certain topic in the period of government and the improvement of the monitoring and following agreements of the sessions with which it can be evaluated the fulfillment of the objectives for which it is created, all the exposed focused from management guidelines public.
