Resumen
Esta investigación analiza el Pleno Sentencia 191/2022 del Tribunal
Constitucional con el fin de determinar si, al negarse a inscribir matrimonios
igualitarios celebrados fuera del país, el Estado peruano incurre en una
afectación al principio de igualdad y no discriminación basada en la orientación
sexual de los contrayentes, específicamente a raíz del celebrado entre Susel
Paredes Piqué y Gracia Aljovín de Lozada. Para ello, se examina la normativa
nacional utilizada en la argumentación del Tribunal Constitucional, así como los
instrumentos internacionales y jurisprudencia relevantes, y así determinar si los
argumentos del voto en mayoría fueron suficientes para negar la inscripción o,
de lo contrario, se habría incurrido en una vulneración de derechos
fundamentales. El estudio concluye que sí existió una vulneración directa del
principio de igualdad y no discriminación por razón de orientación sexual,
centrándose dicho fallo en una lectura literal y restrictiva del concepto de
matrimonio, ignorando las distintas formas de familia que el mismo órgano habría
respaldado en fallos anteriores. Asimismo, se omitió aplicar un correcto control
de convencionalidad y no se analizó pertinentemente pronunciamientos
relevantes de la Corte Interamericana de Derechos Humanos, incumpliendo el
Estado peruano con las obligaciones internacionales.
This research analyzes the Plenary Judgment 191/2022 of the Constitutional Court to determine whether the Peruvian State's refusal to register same-sex marriages celebrated abroad violates the principle of equality and non discrimination based on sexual orientation, focusing specifically on the marriage contracted between Susel Paredes Piqué and Gracia Aljovín de Lozada. To this end, it examines the domestic legal framework used in the Constitutional Court's argumentation, as well as relevant international instruments and case law, to determine whether the majority opinion's arguments were sufficient to deny registration or, conversely, whether a violation of fundamental rights occurred. The study concludes that there was indeed a direct violation of the principle of equality and non-discrimination on the grounds of sexual orientation, as the ruling relied on a literal and restrictive reading of the concept of marriage, thereby ignoring the diverse forms of family that the court itself had recognized in previous rulings. Furthermore, the court failed to properly apply conventionality control and did not adequately analyze relevant pronouncements of the Inter-American Court of Human Rights, thereby breaching the Peruvian State's international obligations.
