Resumen

El presente informe analiza la Resolución N.° 069-2015-OEFA/TFA-SEM, mediante la cual el Tribunal de Fiscalización Ambiental resolvió, en segunda instancia, el procedimiento administrativo sancionador contra Minera Barrick Misquichilca S.A. por infracciones ambientales en la Unidad Minera Pierina. Se abordan tres problemas jurídicos. Primero, si la confirmación de responsabilidad por el incumplimiento del artículo 5° del Reglamento aprobado por Decreto Supremo N.° 016-93-EM vulneró el principio de tipicidad, pues el TFA extrajo de dicha norma una obligación genérica de medidas preventivas que su texto no preveía expresamente. Segundo, si fue correcta la nulidad de la imputación por el artículo 38° del Reglamento de la Ley General de Residuos Sólidos, sustentada únicamente en evidencia fotográfica insuficiente para acreditar la peligrosidad de los residuos. El tercero analiza si la aplicación del artículo 19° de la Ley N.° 30230 restringió la potestad sancionadora de OEFA o si, por el contrario, la reorientó hacia un enfoque preventivo y corrector. A partir de doctrina, jurisprudencia constitucional y pronunciamientos posteriores del TFA, concluimos que el primer extremo vulneró el principio de tipicidad, que la nulidad del segundo fue correctamente declarada, y que la aplicación del artículo 19° resultó válida.
This report analyzes Resolution No. 069-2015-OEFA/TFA-SEM, through which the Environmental Enforcement Tribunal (TFA) ruled, on second-instance review, on the administrative sanctioning proceeding against Minera Barrick Misquichilca S.A. for environmental infractions at the Pierina Mining Unit. The analysis is organized around three legal problems. The first examines whether confirming liability for breach of Article 5 of the Regulation approved by Supreme Decree No. 016-93-EM violated the principle of legal typicity, insofar as the TFA derived from that provision a generic obligation to adopt preventive measures not expressly established in its text. The second assesses the correctness of the nullity declared with respect to the charge under Article 38 of the Solid Waste Regulation, which rested solely on photographic evidence insufficient to prove the hazardous nature of the waste. The third examines whether applying Article 19 of Law No. 30230 restricted OEFA's sanctioning power or, instead, validly redirected it toward a preventive and corrective approach. Drawing on doctrine, constitutional case law, and later TFA rulings, we conclude that the first issue violated the principle of typicity, that the second nullity was correctly declared, and that the application of Article 19 was valid.
