Informe sobre expediente de relevancia jurídica N° 104-2012/CCD y N° 172- 2012/CCD, E-2669 que resuelve desestimar las denuncias interpuestas a Nestlé Perú S.A., en relación con la presunta comisión de actos de competencia desleal en la modalidad de actos de engaño

Resumen
El presente informe examina un procedimiento administrativo sancionador en materia
de competencia desleal en el cual la Sala Especializada en Defensa de la Competencia
confirma la Resolución N.º 021-2015/CCD-INDECOPI, que declara infundada la
denuncia interpuesta por Asociación Peruana de Consumidores y Usuarios (ASPEC) y
el Instituto del Derecho Ordenador del Mercado (IDOM) contra Nestlé Perú S.A., por
presuntos actos de competencia desleal en la modalidad de engaño en el marco de la
campaña publicitaria “Diez minutos de felicidad con Sublime”. El análisis del trabajo
consiste en evaluar Nestlé Perú S.A a través de su campaña publicitaria incurre en
prácticas de competencia desleal que inducen a error a los consumidores, en particular
respecto al inicio de la campaña, el sembrado de los premios y sobre el anuncio que los
empaques no se encuentran marcados; además de evaluar una posible infracción al
principio de legalidad. Todo ello vinculado con la información relevante que debe ser
proporcionada de forma adecuada, oportuna y veraz a través de la publicidad. La
normativa relacionada a la competencia desleal y a la publicidad comercial, sumado con
los principios del derecho del consumidor, constituyen el marco del análisis. Además,
se revisa la decisión de declarar improcedente la denuncia de ASPEC debido a que
previamente se presentó la denuncia de IDOM. Asimismo, se busca evaluar la nulidad
de la Resolución 080-2013/CCD-INDECOPI que declaró fundadas las denuncias de
ASPEC e IDOM.
This report examines an administrative sanctioning procedure in the field of unfair competition, in which the Specialized Chamber for the Defense of Competition upholds Resolution N° 021-2015/CCD-INDECOPI, which declared unfounded the complaint filed by the Peruvian Association of Consumers and Users (ASPEC) and the Institute for the Legal Order of the Market (IDOM) against Nestlé Perú S.A. for alleged acts of anticompetitive practices in the form of deception within the framework of the advertising campaign “Ten Minutes of Happiness with Sublime.” The analysis in this paper consists of evaluating whether Nestlé Perú S.A., through its advertising campaign, engages in unfair competition practices that mislead consumers, particularly regarding the launch of the campaign, the distribution of prizes, and the announcement that packages are not marked. It also assesses a possible violation of the principle of legality. All of this is related to the relevant information that must be provided in an appropriate, timely, and truthful manner through advertising. The analysis is based on the regulations concerning unfair competition and commercial advertising, along with consumer rights and their underlying principles. In addition, the decision to declare ASPEC’s complaint inadmissible, due to IDOM having previously filed the complaint, is reviewed. Furthermore, the report seeks to evaluate the nullity of the Resolution 080-2013/CCDINDECOPI that declared the complaints of ASPEC and IDOM to be well-founded.
