Resumen
El presente informe jurídico analiza la Resolución N.º 08, que declaró infundada
la demanda de anulación parcial de un laudo arbitral derivado del contrato para
la obra Mejoramiento de la Av. Néstor Gambetta. El problema principal radica en
un defecto de control de validez jurisdiccional, debido a que la Sala validó un
laudo que introdujo una decisión sorpresa: fórmulas de descuento y el rubro
“valorización de equipos” que no fueron debatidos por las partes ni fijados como
puntos controvertidos, vulnerando el principio de contradicción y el derecho de
defensa.
Los instrumentos normativos fundamentales empleados en el análisis son la
Constitución Política del Perú (Art. 139 sobre debido proceso), la Ley de Arbitraje
(Art. 63.1.b del Decreto Legislativo N.º 1071) y los principios de la Ley de
Contrataciones del Estado. Se cuestiona específicamente el Considerando 37
del laudo por incurrir en motivación aparente al aplicar un doble descuento sobre
montos ya deducidos en la demanda.
Por tanto, sostengo que la Resolución N.º 08 es jurídicamente incorrecta porque
confundió la prohibición de revisar el fondo con el deber de supervisar el respeto
a los derechos de las partes. Se concluye que el laudo es materialmente
inejecutable al basarse en conceptos técnicos inexistentes y que la omisión de
la Sala produce la ruptura del equilibrio económico-financiero del contrato,
trasladando injustamente costos al contratista.
This legal report analyzes Resolution No. 08, which declared the claim for partial annulment of an arbitral award derived from the contract for the Improvement of Néstor Gambetta Ave. as unfounded. The primary issue lies in a jurisdictional validity control defect, as the Chamber validated an award that introduced a "surprise decision": discount formulas and the category of "equipment valuation" that were neither debated by the parties nor established as controversial points, violating the principle of contradiction and the right to defense. The fundamental regulatory instruments used in the analysis are the Political Constitution of Peru (Art. 139 on due process), the Arbitration Law (Art. 63.1.b of Legislative Decree No. 1071), and the principles of the State Contracting Law. Specifically, Recital 37 of the award is questioned for incurring apparent motivation by applying a "double discount" on amounts already deducted in the claim. The conclusions maintain that Resolution No. 08 is legally incorrect because it confused the prohibition of reviewing the merits with the duty to supervise procedural regularity. It is concluded that the award is materially unenforceable as it is based on non-existent technical concepts, and that the Chamber's omission allowed the breach of the contract's economic and financial equilibrium, unfairly shifting the risk of state delay to the contractor.
