Education with a gender focus was not analyzed under the parameters of the role of the Peruvian state in educational matters, since the judgment issued in the popular action process that questioned its constitutionality and legality did not take into account the constitutionally protected content of the rights of children and adolescents at stake. On the contrary, the analysis only focused on referring to the rights of fathers, mothers and private educational institutions, placing them as the main actors regarding the right to education and ignoring the work of the state in what it means to guarantee a genderfocused education. Therefore, it is vital to differentiate between gender focus and gender ideology, in order to demonstrate that the influence of conservative groups in the legal sphere was what stopped the implementation of the gender focus in education. And although, in theory, this has been determined as a mandatory tool for all educational institutions, personal values that end up displacing the role of the state are still superimposed. However, the imposition of the gender approach in education is constitutionally valid, to the extent that it weighs values of utmost relevance for the integral development of children and adolescents, not only in education, but also in society....

This report analyzes the implications and possible affectation of the right to gender identity of Plaintiff A. in the Sentence No. 384 -2018-2SC issued by the Second Civil Chamber of the Superior Court of Justice of Arequipa. The case deals with the request for a change of sex in the National Identity Card of Plaintiff A., resolved in first instance favorable and in second instance the nullity of this was declared. The author makes a review and critical analysis of the grounds of the judgment in the framework of international standards and the jurisprudence of the Constitutional Court on the recognition of the right to gender identity and its constitutionally protected content, with the objective of determining whether the resolution of the case violates the right to gender identity of the plaintiff A., the development of the report includes a critique of the motivation of the resolution, the identification of the erroneous criterion on the assessment of the legal terms relevant to the case and other procedural aspects. It has been concluded that the appropriate concept of this element is the imposition of a gender stereotype onto women, which discriminates against and subordinates them within the framework of gender-based violence. Therefore, when a woman fails to comply with this imposed stereotype, the perpetrator kills her. Additionally, this work also examines the rational assessment of evidence since proving the occurrence of femicide, a crime based on gender violence, is often very challenging. The case under analysis serves as a clear example of this difficulty, highlighting the need for the judge to apply a gender perspective throughout the entire process, particularly when assessing the means of proof, making logical inferences, and employing the principles of experience. Failure to do so would confine the analysis solely to the specific fact, as in the case that has been analyzed. This report analyzes resolution N.° 0534-2019/SPC-INDECOPI, issued by the Specialized Court for Consumer Protection, in which it is determined that the Chira's Nightclub has violated the mandate of non-discrimination in consumption by having denied the entry to Miss Torres and companions without a justified and reasonable cause. Also, it aims to promote a reflection on cases of discrimination in consumption based on gender identity. Although articles 38 and 39 of the Consumer Protection Code centrally typify the components of the discriminatory act and how the burden of proof is executed in this type of cases, it is not enough to comprehensively examine the case that we are dealing with. For this reason, in addition to consider what is established by the Court regarding the prohibited category of gender identity and its importance, I develop and apply international and national regulations, doctrine and jurisprudence to have a broader panorama about the inclusion of gender identity. as a prohibited reason for discrimination and the evidentiary difficulty in cases of discrimination in order to determine whether the reasons and measures adopted by the Court have been impartial, objective and effective with the special protection the LGBTIQ+ community deserve. The objective of this report will be to present an analysis of the pronouncement of the Inter-American Court of Human Rights in the case of Vicky Hernandez vs. Honduras, whose relevance lies in being the first time that the Court applies the Belém Do Pará Convention in relation to the safeguarding of the rights of trans women. The Inter-American Court declared the responsibility of Honduras for the violation of articles 7.a and 7.b of the CBDP. For this purpose, an analysis of the evolution of the concept "gender" in International Human Rights Law will be made. In addition, reference will be made to the dissenting vote of Judge Odio Benito, to demonstrate the lack of application of an intersectional approach that takes into account the right to gender identity of the victim. Along the same lines, reference will be made to the vote of magistrate Vio Grossi to raise the need to use the dynamic or evolutionary interpretation of articles 7.a and 7.b of the Belém do Pará Convention, so that trans women are included within its scope of protection. Finally, the jurisprudential line on which the Inter-American Court of Human Rights has identified gender stereotypes in the due diligence analysis will be formulated to consider whether it is possible to determine that it is enough to detect the presence of stereotypes in an investigation to conclude that there was no due diligence....

This professional sufficiency work is about the Cassation Nº 1177-2019-Cusco. The method used is based on determining the relevant facts of the case, followed by the development of the legal issues. Then, an analysis of each of these issues is carried out, considering the position of the Bachelor, conclusions, and recommendations. It is observed that Mrs. Gregoria was allegedly a victim of physical and psychological abuse in a context of genderbased violence by her cohabitant. However, she did not find justice as the judicial operators charged the perpetrator with the offense of assaults against women instead of attempted feminicide. In this regard, there is a lack of adequacy in assessing the elements of the crime of feminicide since the Court only focused on evaluating the suitability of the weapon and the level of injuries caused by the perpetrator as the main issue. The analysis of the case lacks proper reasoning and motivation to support the decision made. Finally, the judicial operators did not apply a gender perspective in the specific case, which is detrimental to the study of crimes committed in the context of gender-based violence. This approach needs to be used in line with international standards to achieve a Peru with social justice and equal rights....
