This article analyses the treatment of migrant’s right to an effective remedy in two Human Right Systems: The Inter-American System of human rights and the European system of human rights. The importance of this is due to the fact that the right to an effective remedy is the first step to protect migrants. In fact, if the right to an effective remedy is violated, the doors are closed for the protection of other rights such as the right to life, the right to physical integrity, the right to not be tortured, among others. In that sense, States have to respect the right to an effective remedy as a minimum step towards international standards of migrants. However, the issue becomes more complex, since the right to an effective remedy is composed of other essential rights for their correct implementation in the legal processes. On that line, we have chosen the comparative analysis of the right to an effective remedy of both regional systems of human rights, for the purpose of identify their characteristics, advantages and disadvantages. Lastly, we will conclude that each of the systems has developed some aspects compared to others because of the characteristics of each migratory corridor of the region....

The research aims to provide the content, systematization and operational implementation of the penalthy of disqualification from them peruvian criminal law. It takes as a start point the historical study, that allows to observe their transition in the systmes of penalties until the present, it doesn`t save an unrelated – function with the other penalties that are contained in this catalog. Facing the challenges of the Administration of Justice, it is necessary to influence the renewal of the penalty of disqualification to a previous level to the judicial decision, that is to say, the persecutor of the crime should be determined under the guns of the principle of legality, guilt, reasonableness and proportionality. Thus, make it viable the efficiency in the process of the judicial determination of the death penalty to be imposed. Finally, discusses the foray into the faults, in alternative measures to imprisonment, giving the aforementioned worth a look that fits the parameters of a constitutional criminal law that it is the maximum efficiency of the guarantees and not the objectification of the person....

The concept of progressivity, understood as the gradual fulfillment of human rights, was historically a problematic category, which served as a justification for non-compliance and state inaction. In fact, the misunderstanding of this term has led to the non-recognition of the enforceability and justiciability of social rights, which are considered to be mere good intentions. Moreover, it would generate impunity in the event of a violation of any right. However, this concept has evolved with the normative and jurisprudential development of International Human Rights Law (IHRL). This evolution of the concept has influenced the Peruvian legal system and is reflected in the regulations and jurisprudence. However, it is necessary to highlight that the conceptions of progressivity in international law and domestic law are dissonant. For this reason, this paper will seek to provide an approach to the concept of progressivity in the peruvian legal system based on the analysis of international instruments and the jurisprudence of the Constitutional Court. In the end, it is possible to conclude that the most favorable concept of progressivity for the protection and fulfillment of human rights should be adopted. In this sense, I consider that progressivity should be understood as the effective and constant advancement of the right and that gradualness shall not be used as an excuse for the State not to issue guarantee measures, and the progress obtained cannot be unjustifiably regressive....
